Order data processing

Order data processing occurs when a contractor is commissioned with the processing of personal data without being given responsibility for the associated business process.  In these cases, an agreement on order data processing must be concluded with the external contractor. The contracting company remains fully responsible for the correct execution of the data processing.

The contractor may only process personal data in accordance with the instructions of the client.  The following requirements must be observed when placing the order:

1.     The contractor is to be selected according to its suitability to ensure the necessary technical and organizational protective measures

2.     The order must be placed in text form.  The instructions for data processing and the responsibilities of the client and the contractor must be documented.

3.     The order must be placed in text form.  The instructions for data processing and the responsibilities of the client and the contractor must be documented.

4.     The contract standards provided by ColorDigital must be observed.

5.     The client must ensure that the contractor's obligations are met before data processing begins.  A contractor can demonstrate compliance with the data security requirements, in particular by presenting a suitable certification.  Depending on the risk of data processing, the check may have to be repeated regularly during the contract period.

In the case of cross-border order data processing, the respective national requirements for the transfer of personal data abroad must be met.  In particular, the processing of personal data from the European Economic Area may only take place in a third country if the contractor can demonstrate a level of data protection equivalent to this data protection directive.

With the cloud solution offered, ColorDigital is a data processor to the customer.  ColorDigital is committed to complying with the above  Principles.  Under this link you will find ColorDigital GmbH's order data processing contract: (Link)
